These terms govern your use of design.dog and any services you purchase from James Eaton Design, Inc., doing business as design.dog (“design.dog,” “we,” “us”). By using this site or purchasing a service, you agree to these terms.
1. Services
We provide brand strategy, design, and website services as described on this site or in a written proposal or agreement. If a proposal or agreement exists for your project, its terms control where they differ from these.
2. Payment
Prices are listed in U.S. dollars. Projects require a deposit to reserve your start date, with the balance due at completion unless otherwise agreed. Payments are processed securely by Stripe. Work may be paused if an invoice is more than [14] days past due.
3. Cancellations and refunds
Deposits reserve time on our calendar and are non-refundable once work has begun. If you cancel before work begins, we will refund your deposit minus [any non-recoverable costs]. Completed work and delivered services are not refundable. If you’re unhappy with something, contact us. We’ll work in good faith to make it right.
4. Scheduling and client responsibilities
Project timelines depend on receiving content, feedback, and account access on time. Delays in providing these may shift your delivery date. You are responsible for the accuracy and legality of the content you provide, and you confirm you have the right to use it.
5. Accounts and third-party services
Your website, domain, hosting, and payment accounts remain in your name and under your control. Our services may rely on third-party platforms such as Webflow and Stripe. We are not responsible for their outages, policy changes, fees, or decisions, including payment holds.
6. Ownership
Once paid in full, you own the final deliverables created for you. We retain ownership of our pre-existing tools, templates, code, and working files, and grant you a license to use any of them included in your deliverables. We may display completed work in our portfolio unless you request otherwise in writing.
7. Revisions and scope
Each service includes the revisions described in its offer or proposal. Requests beyond the agreed scope will be quoted separately before any additional work begins.
8. No guarantees
We work hard to help your business succeed, but we can’t guarantee specific results such as sales, leads, or search rankings. Services are provided “as is” except as expressly stated in a written agreement.
9. Limitation of liability
To the extent permitted by law, our total liability for any claim related to our services is limited to the amount you paid us for the service in question. We are not liable for indirect, incidental, or consequential damages, including lost profits.
10. Use of this site
Content on this site is owned by design.dog and may not be copied or reused without permission. You agree not to misuse the site or its contact forms.
11. Governing law
These terms are governed by the laws of the State of Illinois. Any disputes will be resolved in the state or federal courts located in [Will County], Illinois.
12. Changes
We may update these terms from time to time. The effective date above shows the latest version. Terms in effect at the time of your purchase apply to that purchase.
